Official Rules for the SkinStore.com NIA24 Giveaway

PROMOTION BEGINS ON JANUARY 18, 2011 AND ENDS ON FEBRUARY 7, 2011. NO PURCHASE IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to SkinStore.com and not TO Facebook. The information you provide will only be used for sending NIA24 GIVEAWAY updates, ANNOUNCING THE PRIZE WINNERS, and for other promotional NOTIFICATIONS; you may opt-out of these notifications at anytime.

1. ELIGIBILITY. The Salu Beauty, Inc. (hereinafter “SkinStore.com”) “NIA24 Giveaway” (hereafter “Giveaway”) is open to all legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Those not located within the United States are not eligible to participate or win a prize. In addition, the following individuals are not eligible to participate or win a prize:

• (a) employees, officers, directors, agents and representatives of SkinStore.com and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising, and promotion agencies (“Excluded Individuals”); or
  
  
• (b) the immediate family members (mother, father, sister, brother, child, husband, wife, and their respective spouses, regardless of where they reside) of Excluded Individuals; or
  
  
• (c) persons living in their same household as Excluded Individuals — whether or not they are related. Void where prohibited by law; all applicable federal, state, and local laws apply. If a winner is at least 18, but still considered a minor in his or her jurisdiction of residence, SkinStore.com reserves the right to award the prize to the winner’s parent or legal guardian who will be responsible for fulfilling all requirements set forth herein.

2. PROMOTION PERIOD. The Giveaway begins 12:00:00 am Pacific Time on January 18, 2011 and ends 11:59:59 pm Pacific Time on February 7, 2011 (hereafter, “Promotion Period”).

3. HOW TO ENTER. No purchase is necessary to enter. You may enter using one of three options:

• (a) by the deadline submit a valid entry through the “NIA24 New You Confessions” application on the SkinStore.com Facebook page (“SkinStore.com page”). First, you must “like” SkinStore.com to reveal the “NIA24 New You Confessions” application found on the “Giveaway” tab on the SkinStore page. Second, you must fill in all fields on the entry form including (1) answering the one featured question; and (2) providing the requested contact information, consisting of name, address, city/town, state, ZIP code, country, email address, and phone number. By entering the contest, the entrant’s email address will be added to the SkinStore.com customer email program, from which the entrant can opt-out at any time. Only one entry per person will be accepted. The Giveaway contest entry form will be hosted and must be filled out at the SurveyMonkey website. All entries will be subject to the SurveyMonkey Terms and Conditions; or
  
  
• (b) by the deadline submit a valid e-mail address and comment through the “NIA24 New You Confessions” blog post on the Official SkinStore.com blog located at blog.SkinStore.com; or
  
  
• (c) neatly hand-print your complete name, address, city, state, zip code, date of birth, telephone number, and e-mail address on a plain 3" x 5" piece of paper. Mail your completed 3" x 5" piece of paper in an envelope to: SkinStore.com NIA24 Giveaway, SkinStore.com, 11344 Coloma Road, Suite 725, Gold River, CA 95670. All entries must be received no later than the deadline to be eligible for the final drawing. No photocopies or mechanically reproduced entries will be accepted. No responsibility is assumed for lost, late, illegible, incomplete, damaged, misdirected, or postage-due entries.

4. PRIZES. SkinStore.com will give away five (5) NIA24 skin care regimens (the “Prizes”). The approximate retail value of each Prize is $300-325.00. Any cost or expense associated with the acceptance or use of the prize not specified herein as being awarded, including, but not limited to, federal, state, or local taxes, are winner’s sole responsibility. Limit one Prize per household. All prize details are at the sole discretion of SkinStore.com. No transfer, assignment, cash redemption, or substitution of prize is permitted, except by SkinStore.com, who reserves the right to substitute the prize with one of comparable or greater value.

5. ESTIMATED ODDS OF WINNING. The odds of winning depend upon the total number of eligible entries received. All five (5) Prizes will be awarded.

6. HOW WINNERS ARE SELECTED. Five (5) winners will be chosen in a random drawing of those who correctly enter the Giveaway to be held on or about February 9, 2011. By entering, entrants agree to be bound by these Official Rules and to the decisions of SkinStore.com, which will be final and binding in all respects. SkinStore.com reserves the right (but is not obligated) to verify eligibility qualifications of the potential winner. Winners may be required to sign an Affidavit of Eligibility and Liability/Publicity Release. SkinStore.com reserves the right, in its sole discretion, to void any entries of entrants in violation of these Official Rules or believed to have attempted to tamper with or impair the administration, security, fairness, or proper play of this Giveaway.

7. HOW WINNERS ARE NOTIFIED. Each winner of the drawing will be notified by e-mail.

Non-compliance with these Official Rules, the inability to contact a potential winner within seven (7) days of attempted notification, or return of prize notification as non-deliverable, may result in disqualification of winner and—at the discretion of SkinStore.com—awarding of the prize to an alternate winner.

8. WINNERS’ NAMES. SkinStore.com will post on the SkinStore on Facebook page, on Twitter and on the Official SkinStore Blog, the winner’s first name, first letter of the person’s last name, and the abbreviation of the state in which the person resides. The winners of the drawing may also be announced on the SkinStore.com page on or around February 9, 2011. For a complete list of the winners, send a self-addressed and stamped envelope after February 16, 2011 and before February 16, 2012 to: SkinStore.com NIA24 Giveaway, Attn: NIA24 Giveaway Winners, 11344 Coloma Road, Suite 725, Gold River, CA 95670.

9. HOW SKINSTORE.COM USES ENTRIES. By entering, entrants agree: (1) that SkinStore.com will contact winners by e-mail and will post the names of winners on the SkinStore.com on Facebook page, SkinStore Twitter page, and the Official SkinStore Blog; (2) that SkinStore.com may contact entrants in the future regarding SkinStore.com promotions or offers; (3) that neither SkinStore.com nor Facebook will have any liability and both will be held harmless by entrant for any claim, action, liability, loss, injury, or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, arising in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, misuse or nonuse of the prize; (4) that entrants waive all rights to claim from SkinStore.com or Facebook any punitive, incidental, or consequential damages, attorneys’ fees, or any damages; (5) to be bound by these Official Rules and the decisions of SkinStore.com, which are final and binding on all matters relating to the Giveaway; and (6) to waive any right to claim any ambiguity or error in these Official Rules or the Giveaway itself.

10. DISCLAIMER. SkinStore.com is not responsible for late, lost, stolen, damaged, illegible, incomplete, misdirected, delayed, garbled, inaccurate, postage due or undelivered mail, or for telephonic, human, or computer failures, interruptions in service due to system upgrades, repairs, modifications, or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Giveaway, including, without limitation, errors which may occur in connection with the administration of the Giveaway, the processing of entries or mail or the announcement, delivery or use of the prizes, or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Giveaway, or for printing, typographical, computer, network, electronic, mechanical, human or other errors appearing in these Official Rules or other Giveaway-related materials.

Any attempt to deliberately damage any website or undermine the legitimate operation of this Giveaway is a violation of criminal and civil laws and should such an attempt be made, SkinStore.com reserves the right to seek damages (including attorneys’ fees) and other remedies from any such person responsible for the attempt to the fullest extent permitted by law. SkinStore.com reserves the right, in its sole discretion, to disqualify any entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Giveaway or is in violation of these Official Rules and void all associated entries.

11. RIGHT TO CANCEL SWEEPSTAKES. If for any reason this Giveaway is not capable of being run or implemented as planned (as determined by SkinStore.com in its sole discretion), including, but not limited to, tampering, unauthorized intervention, fraud, computer viruses or bugs, or any other cause of any kind, which, in SkinStore.com’s sole judgment, any cause whatsoever is likely to or actually corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of the Giveaway (including, but not limited to, tampering, unauthorized intervention, fraud, or any other cause of any kind), then Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend all or any part of the Giveaway or to disqualify any implicated entrant and any associated entries. In the event of cancellation or termination, SkinStore.com reserves the right, at its sole discretion, to pick the winner in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or termination. In the event this Giveaway is cancelled prior to the stated end date, a notice will be posted at the SkinStore.com website.

12. UNFORSEEN CIRCUMSTANCES. The failure of SkinStore.com to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, action of governmental authorities, or any force majeure event or event outside the control of SkinStore.com will not be considered a breach of these Official Rules.
